The two most significant factors in determining the penalties that may be imposed upon you are; your level of intoxication or blood alcohol content (BAC), and, the number of DUI convictions you have in your past.

The penalties for DUI could range from six months probation to a mandatory one year in jail. Additionally, with almost all DUI convictions, a suspension of your Driver’s License for up to eighteen months is automatic.

If you are a first time offender, you may be eligible for a program called Accelerated Rehabilitative Disposition (ARD). The ARD Program eliminates the mandatory jail time requirements for first time offenders, and, upon successful completion of the Program, you will not have any Criminal Record.
